# THR0TTLE — End User Licence Agreement (EULA)

This agreement is between you and the operator of THR0TTLE
("we/us"). By creating an account or using the app you accept it.

## 1. Licence
We grant you a personal, non-transferable, revocable licence to use
THR0TTLE on your own devices for its intended purpose: connecting
with other motorcycle riders, organising rides and events, and
related community features. You may not copy, modify, reverse-
engineer, resell or redistribute the app or any part of it.

## 2. Accounts
You must provide accurate information, be at least 18 years old, and
keep your login credentials private. You are responsible for
activity on your account. We may suspend or terminate accounts that
break this agreement or the law.

## 3. Rider safety — important
THR0TTLE is a social planning tool, **not a safety device**.
- Riding motorcycles is inherently dangerous. You ride at your own
  risk and remain solely responsible for your own safety, riding
  decisions, licensing, insurance and roadworthiness.
- The SOS Ride Guard feature is a best-effort convenience that
  depends on your phone's battery, signal, GPS and permissions. It
  can fail. **It is not a substitute for emergency services (10111 /
  112) or medical assistance.** We accept no liability for any
  failure of the feature to detect an incident or deliver an alert.
- Rides and events are organised by users, not by us. We do not vet
  routes, organisers or participants.

## 4. Your content (UGC)
You keep ownership of the content you post (photos, messages,
statuses, ride details) and grant us a worldwide, royalty-free
licence to host, display and transmit it as needed to run the
service. You warrant your content does not infringe anyone's rights
and is lawful. Prohibited: illegal content, harassment, hate speech,
nudity involving minors, incitement of dangerous or unlawful riding,
spam, and impersonation. We may remove content or accounts at our
discretion, and we operate a report/review process in the app. We
are a hosting platform for user content and do not endorse it;
responsibility for user content lies with the user who posted it.

## 5. Premium subscriptions
Premium features are provided on a monthly subscription (currently
R69.99/month in the app, R49.99/month on the website) billed through the payment provider shown at purchase.
Cancelling stops future billing; you keep Premium until the end of
the paid period. Prices may change with notice. Fees already paid
are non-refundable except where the Consumer Protection Act 68 of
2008 ("CPA") requires otherwise.

## 6. Privacy (POPIA)
We process personal information (name, contact details, location,
photos, messages) to provide the service, per our Privacy Policy and
the Protection of Personal Information Act 4 of 2013. You may
request access, correction or deletion of your personal information
at any time. Emergency-contact details you provide are used solely
for the SOS feature.

## 7. Availability and changes
The service is provided "as is" and "as available". We may modify,
suspend or discontinue features. We do not warrant uninterrupted or
error-free operation.

## 8. Limitation of liability
To the maximum extent permitted by law (and without limiting any
right you have under the CPA that cannot be excluded): we are not
liable for indirect or consequential loss; our total liability for
any claim is limited to the subscription fees you paid us in the 12
months before the claim. Nothing in this agreement limits liability
for gross negligence or wilful misconduct, or excludes rights that
South African law does not allow to be excluded.

## 9. Disputes
This agreement is governed by South African law. Disputes will
first be attempted in good-faith negotiation. Either party may refer
a dispute to arbitration in South Africa under the rules of the
Arbitration Foundation of Southern Africa (AFSA), **provided that**
nothing prevents you from exercising any right under the CPA,
including approaching the Consumer Goods and Services Ombud, the
National Consumer Commission, or a court where the CPA entitles you
to do so.

## 10. Termination
You may stop using the service and delete your account at any time.
Sections 3, 4, 8 and 9 survive termination.
